Terms of Service

These terms govern your use of Caselist (the "service"). Caselist is operated as a sole trader business based in England and Wales. In these terms, "we" and "us" mean the operator of Caselist. By creating an account or using Caselist, you agree to these terms. If you don't agree, don't use the service.

1. The service

Caselist is a software service for tracking flight cases, gear inventory, and venue check-ins. We provide the software. You provide the data you put into it. The service is delivered as-is, with reasonable effort to keep it running, but without uptime guarantees on free plans.

2. Your account

  • You must be at least 16 years old to create an account.
  • You're responsible for keeping access to your email secure. We don't store passwords. You sign in with a one-time code we email you.
  • You're responsible for anything that happens under your account, including actions by anyone you give workspace access to.
  • You agree not to give someone access to your email inbox if you don't intend to give them workspace access.

3. Workspaces, members, and ownership

  • Each workspace has one owner, who has full control including the right to delete the workspace.
  • Owners can invite admins and members and can transfer ownership to another member.
  • You're responsible for ensuring that anyone you invite has agreed to these terms and to our privacy notice.
  • Data in a workspace belongs to the workspace, not to any individual member. Members who leave or are removed lose access to that workspace's data.

4. Acceptable use

You agree not to:

  • Use the service to store or transmit content that's illegal under English law, infringes third-party rights, or facilitates fraud.
  • Reverse engineer, scrape, or attempt to circumvent rate limits or access controls.
  • Use the service to spam other users or to harvest personal data.
  • Resell or sublicense the service without our written agreement.
  • Run automated load against our service beyond reasonable use of the product.

We can suspend or close any account that we reasonably believe is breaching these rules. We'll let you know when we do this where it's possible to do so without compromising other users.

5. Plans, payments, and refunds

  • Free plans are free. Paid plans are billed in advance through Stripe, in GBP unless stated otherwise.
  • You can cancel any subscription from the billing portal. Your plan stays active until the end of the current billing period.
  • We don't offer pro-rata refunds for partial periods. If you've been billed in error, contact hello@caselist.app and we'll sort it.
  • Prices can change. We'll give at least 30 days' notice by email for any change to a price you're already paying.
  • Lifetime purchases give the buyer access at the equivalent of the Crew tier for the lifetime of the service. "Lifetime" means as long as we operate Caselist as a product. If we wind the service down, we'll give at least 90 days' notice.

6. Your content

Anything you put into Caselist, including case lists, photos, notes, and reports, stays yours. You grant us a limited licence to host, process, and display that content as needed to run the service for you. We don't claim ownership and we don't use your content to train AI models.

You're responsible for having the right to upload anything you upload. Don't upload anything where someone else holds the IP unless you have permission.

7. Our intellectual property

The Caselist software, brand, and design are ours. These terms don't transfer any of those rights to you. You're licensed to use the service while your account is active. You don't get to copy, redistribute, or build a competing product on top of it.

8. Privacy

We process personal data as set out in our Privacy Policy. That document explains what data we hold, why, and your rights.

9. Service availability

We aim to keep Caselist available with high reliability, but we don't promise a specific uptime percentage on standard plans. We may take the service offline for maintenance, security, or any other reasonable operational reason. Scheduled maintenance is announced where possible.

10. Liability

To the maximum extent permitted by law, our total liability to you for any claim related to the service is limited to the greater of (a) £100, and (b) the amount you paid us in the 12 months before the claim arose.

We're not liable for indirect, consequential, or incidental losses, including loss of profits, loss of revenue, loss of data beyond what backups would reasonably recover, or third-party costs incurred because of a fault in the service.

Nothing in these terms limits any liability that can't be limited by law, including for death or personal injury caused by our negligence, or for fraud.

11. Termination

You can stop using Caselist any time by deleting your workspace from the settings page. We can suspend or close your account for breach of these terms, non-payment, or to comply with a legal obligation. On termination, we keep the right to retain anonymised usage data and any data we're legally required to keep. Personal data is deleted in line with the Privacy Policy.

12. Changes to the service or terms

We can change the service over time, including adding, removing, or modifying features. If we make a change to these terms that materially reduces your rights, we'll let you know by email at least 14 days before it takes effect. Continuing to use the service after that means you accept the new terms.

13. Governing law

These terms are governed by the laws of England and Wales. Any dispute will be subject to the exclusive jurisdiction of the courts of England and Wales.
